On the contrary, perhaps they are (so they think). You don't really make this clear in your first post, but the assumption is that it's OpenWrt photographed in the image on the eBay product link you provided.
It's possible that the OS pictured in the photograph is actually the Qualcomm SDK and not OpenWrt.

as long as they didn't send you an un-blurred version of the picture they had in the eBay auction, there's no real proof of it ...
even then, it could still be fake, I can recreate that pic in 15 sec.
I was thinking that it was faked, but something about the whole setup, seems off to me. Perhaps someone can get farther than I can with the seller? All I get are lies
