5G frequency country compatibility

Hi There,
I recently set up a new device (not using previous settings) and I realize the 5GHz band accessible channels to be possibly outside the local regulatory.
It is seen on v22.03.3 and v23.05.5 as well.
I'm localized in France country code FR. While regulatory for 2.5GHz channels works well it look not working properly for 5GHz ones (Luci selection or iw reg listing). As an example I was able to connect my mobile to the AP with Internet access on channel 149 which shall not be possible in France.
What is my mistake

Works in Belgium ( Country code BE) quite well on channel 149, takes a minute on DFS channels for radio to settle.

yes it works, that's what I say but beleive it shall not
as well channels 144 to 173 shall not operate in France (as well as in Belgium)
Right?

Wrong, in all EU it works with measly 25mW power.

Add
option channels '36 52 100 116'
To 5ghz radio section to stay out of the super weak unusable range.
